MANDATORY CONFORMITY ASSESSMENT
- Mandatory Conformity Assessment is carried out as mandatory certification and conformity declaring.
- According to the Federal Law “On Technical Regulating” mandatory certification is only carried out in those cases that are established by a relevant technical regulation, and exclusively for conformity to technical regulation requirements. A form and plans of mandatory conformity Assessment can also be established solely by a technical regulation regarding risk measure of non-achievement of technical regulations aims.
- A subject of Mandatory Conformity Assessment can only be products issued in the territory of the Russian Federation.
- At present the mandatory certification activity is carried out within certification systems. When relevant technical regulations become effective products on which the corresponding technical regulation covers, shall be excluded from the mandatory certification system.
- The most developed certification system is the GOST R certification system. It incorporates more than 1100 certification bodies and about 2500 test laboratories. The GOST R certification system has its own forms of conformity certificates and conformity marks.
- Normative base of products mandatory certification in the transitional period includes National Standards, Sanitary Codes and Norms, Construction Norms and Rules as well as other documents that establish mandatory requirements for products according to laws of the Russian Federation.
- List of products subject to mandatory certification is established in RF Government Decree № 1013 as of August 13, 1997 (with modifications and supplements) “On approval of List of goods subject to mandatory certification, and the List of work and services subject to mandatory certification”.
- Products Nomenclature in respect to which acts of law provide mandatory certification is official reference information on subjects of mandatory certification in GOST R Certification System.
- In addition to GOSSTANDART of Russia Decree № 64 as of July 30, 2000, “On products and services (work) nomenclature subject to mandatory certification and Products nomenclature which conformance can be assured by conformity declaration (with modifications as of November 29, December 31, 2002; January 8 and 13, April 15, May 12, June 5 and 26, October 8, 2003; June 22, 2004) Federal Agency on Technical Regulating and metrology Order № 267 as of February 8, 2006 “On introduction of modifications into Products Nomenclature in respect of which acts of laws provided mandatory certification in the Russian Federation as well as into Products Nomenclature subject to conformity declaring” is in force
- Both a manufacturer and a purchaser have the right to apply for mandatory certification to any Certification body accredited to certify the specified product.
- Procedures and certification Procedure for products certification in the RF are established in “The Procedure of products certification in the Russian Federation” (with modifications and supplements). This document describes the sequence of work fulfilled by the participants of certification, Certification Plans, and recommendations for their application.
- Characteristics of certification of the specific kinds of products are established in respective rules wherein the specificity of manufacture and use of the products is considered.
- According to Statute of the Federal Agency on Technical regulating and Metrology, approved by Russian Federation Government Decree № 294 as of June 17, 2004, The Agency is entrusted with maintaining the List of Products subject to Mandatory Conformity Assessment as well as the Common Register of Certificates Issued.
CONFORMITY DECLARATION
- The first steps to implementation of conformity declaration were made in 1998 when the RF law “On products and services certification“ was supplemented with the clause providing conformity Assessment by declaration.
- Accordingly, in 1999, the Russian Federation Government for the first time has approved the List of products whose conformance could be assured by a conformity declaration, and the Procedure of recognition of the conformity declaration and its registration. About 15%-20% of products subject to obligatory certification are included into this List that is valid up to now. Now the work on decreasing redundancy of obligatory certification is under way.
- When declaring conformity an applicant can be a registered according to Russian Federation Law in its territory legal entity or a physical entity as an individual industrialist which are either manufacturers or vendors, or which carry out the functions of a foreign manufacturer basing on an agreement with him in the part of provision of conformity of supplied products to Technical Regulations requirements and in the part of responsibility for non-conformity of supplied products to Technical Regulations requirements (a person which carries out the functions of a foreign manufacturer). A circle of applicants is established by a respective regulation.
- Conformity declaring is carried out by one of the following schemes:
- acceptance of a conformity declaration on the base of the own proofs;
- acceptance of a conformity declaration on the base of the own proofs, and proofs received with the participation of a certification body and/or an accredited test laboratory (center) (further – the third party).
- According to Statute of the Federal Agency on Technical regulating and Metrology, approved by Russian Federation Government Decree № 294 as of June 17, 2004, The Agency is entrusted with maintaining the List of Conformity Declarations Registered.
- Conformity declaring in the transitional period is carried out according to the Procedure of acceptance of the conformity declaration and its registration approved by Russian Federation Decree № 766 as of June 7, 1999.
